Terms of Service

PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OUR WEBSITE ORUSING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS OF SERVICE AND OURPRIVACY POLICY. IF YOU DO NOT AGREE, DO NOT USE OUR SITE OR SERVICES.

1. Acceptance of Terms

These Terms of Service("Terms") constitute a legally binding agreement between you("Customer," "User," or "you") and The WolferyCompany ("The Wolfery," "we," "us," or "our"),a business headquartered in San Francisco, California, governing your access toand use of our website at thewolferycompany.com (the "Site") and allrelated subscription services, products, and features (collectively, the"Services").

By accessing our Site, submittingour intake form, placing an order, or subscribing to our Services, yourepresent that you are at least 18 years of age, have the legal capacity toenter into a binding contract, and agree to be bound by these Terms in theirentirety.

We reserve the right to modifythese Terms at any time. Material changes will be communicated via email orprominent notice on the Site. Your continued use of our Services after anymodification constitutes acceptance of the updated Terms.

2. Description of Services

The Wolfery provides premium,chef-prepared fresh dog food on a subscription basis, delivered to customers inthe San Francisco Bay Area and surrounding regions. Our Services include:

•      Weekly and biweekly freshdog food subscription delivery

•      Personalized feeding plansgenerated through our Feeding Intelligence Engine (FIE)

•      Customer account managementthrough our website and third-party platforms

•      Nutritional guidance andsupport communications

All food products are preparedusing human-grade ingredients in a licensed commercial kitchen. Recipes andformulations are proprietary and developed by our founder, a trained chef withMichelin-restaurant experience.

The Wolfery reserves the right tomodify, suspend, or discontinue any aspect of the Services at any time withreasonable notice to active subscribers.

3. Subscriptions, Orders, and Billing

3.1 Subscription Plans

Our Services are offered on asubscription basis. Available plans include weekly and biweekly deliveryintervals. Monthly subscriptions are not offered, as fresh food qualityrequires more frequent delivery cycles. By subscribing, you authorize us to chargeyour payment method on a recurring basis according to your selected plan.

 

3.2 Pricing

Subscription pricing is based onyour dog's weight category and selected protein. Prices are displayed on ourSite at the time of signup. We reserve the right to adjust pricing with atleast 14 days' written notice to active subscribers. Continued subscriptionafter the notice period constitutes acceptance of the new pricing.

 

3.3 Billing and Payment

Billing occurs on a recurringschedule based on your subscription plan. Charges are processed through ourthird-party payment processors (Shopify Payments / Stripe). You agree tomaintain valid payment information. Failed charges may result in suspension orcancellation of your subscription after reasonable notice. We are not liablefor any fees your bank or card issuer may charge in connection with ourbilling.

 

3.4 Order Cutoffs and Delivery

Orders are subject to weeklyproduction cutoffs. Orders placed after the cutoff will be processed in thefollowing production cycle. Delivery schedules are provided at signup and maybe adjusted with advance notice. We are not liable for delays caused bycircumstances beyond our reasonable control, including but not limited toweather, carrier issues, or force majeure events.

 

3.5 Cancellations and Refunds

You may cancel your subscriptionat any time through your account portal or by contacting us atthealpha@thewolferycompany.com. Cancellations must be submitted before theweekly order cutoff to avoid being charged and fulfilling the next productioncycle. Due to the perishable nature of our fresh food products, all sales arefinal once production has commenced for your order. We do not offer refunds fororders already in production or delivered. Exceptions may be made at our solediscretion in cases of verified product defect or delivery failure caused byThe Wolfery.

4. Acceptable Use Policy

By accessing our Site or Services, you agree to use them only for lawful purposes and in accordance with theseTerms. You agree not to:

•      Use our Site or Servicesfor any fraudulent, unlawful, or unauthorized purpose

•      Submit false, misleading,or fabricated information through our intake forms or any communication channel

•      Impersonate any person,entity, or business in any submission or communication

•      Attempt to gainunauthorized access to our systems, data, or accounts

•      Introduce malware, viruses,or harmful code to our Site or systems

•      Use automated tools, bots,or scrapers to interact with our Site without our written permission

•      Interfere with or disruptthe integrity or performance of our Site or Services

•      Harass, threaten, or abuseour founder, employees, contractors, or other customers through any channel

•      Use our contact forms orintake forms for any purpose other than genuine service inquiries

Violation of this Acceptable UsePolicy may result in immediate termination of your account and subscription,and may expose you to civil and/or criminal liability as described in Section10.

5. Intellectual Property

All content on our Site, includingbut not limited to text, graphics, logos, images, recipes, formulations, theFeeding Intelligence Engine methodology, and software, is the exclusiveproperty of The Wolfery Company or its licensors and is protected by applicablecopyright, trademark, and intellectual property laws.

You are granted a limited,non-exclusive, non-transferable license to access and use our Site and Servicesfor personal, non-commercial purposes. You may not reproduce, distribute,modify, create derivative works of, publicly display, or exploit any portion ofour content without our prior written consent.

"The Wolfery," "TheWolfery Company," our logo, and related marks are trademarks of TheWolfery Company. Nothing in these Terms grants you any right to use ourtrademarks without our express written permission.

6. Food Safety, Health Disclaimer, and Limitation of Liability

6.1 Food Safety

Our products are prepared usinghigh-quality, human-grade ingredients in a licensed commercial kitchen. Ourrecipes are developed to meet or exceed nutritional guidelines for dogs.However, every dog is different. You are responsible for monitoring your dog'shealth and response to our food and for consulting with a licensed veterinarianbefore making significant changes to your dog's diet.

 

6.2 No Veterinary Advice

Nothing on our Site or in ourcommunications constitutes veterinary advice, diagnosis, or treatment. OurFeeding Intelligence Engine provides personalized feeding recommendations basedon information you provide but is not a substitute for professional veterinaryguidance. Always consult your veterinarian regarding your dog's specific healthneeds, dietary restrictions, and medical conditions.

 

6.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BYAPPLICABLE LAW, THE WOLFERY COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT,INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USEOF OUR SERVICES OR PRODUCTS, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OFPROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEENADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

 

Our total liability to you for anyclaim arising from your use of our Services shall not exceed the total amountyou paid to us in the three (3) months preceding the claim.

 

6.4 Indemnification

You agree to indemnify, defend,and hold harmless The Wolfery Company, its founder, officers, employees,contractors, and agents from and against any claims, liabilities, damages,losses, and expenses (including reasonable attorneys' fees) arising out of orin any way connected with: (a) your use of our Services; (b) your violation ofthese Terms; (c) your violation of any applicable law or regulation; or (d) anyfalse, defamatory, or harmful content you publish or distribute about TheWolfery or its personnel.

7. Reviews, Public Statements, and Defamation Policy

7.1 Honest Reviews

The Wolfery welcomes honest,good-faith reviews and feedback from verified customers based on their genuineexperience with our products and Services. We believe in transparency andaccountability and stand behind the quality of our food and service.

 

7.2 Prohibition on False and Defamatory Statements

The following conduct is strictlyprohibited and constitutes a material breach of these Terms:

•      Publishing false statementsof fact about The Wolfery, its products, food safety practices, businessoperations, founder, or personnel on any platform, including Google, Yelp,social media, blogs, forums, or any other public channel

•      Submitting fake,fabricated, or maliciously inaccurate reviews intended to deceive prospectivecustomers or damage The Wolfery's reputation

•      Making false accusationsabout the safety, quality, or integrity of our products without factual basis

•      Filing false or knowinglyinaccurate complaints with regulatory bodies, health departments, consumerprotection agencies, or any governmental authority

•      Coordinating with others toartificially harm The Wolfery's reputation through false or misleadingstatements

•      Publishing content thatconstitutes trade libel — false statements of fact that harm our business

7.3 Dispute Resolution Before Public Statements

If you have a genuine complaintabout our products or Services, we strongly encourage you to contact usdirectly at thealpha@thewolferycompany.com before making any public statement.We are committed to resolving legitimate complaints promptly and fairly.Customers who bypass direct resolution in favor of false or exaggerated publicstatements waive any goodwill consideration in any subsequent dispute.

7.4 Legal Remedies for Defamation and False Reviews

The Wolfery Company activelymonitors public platforms for false or defamatory content and will takeappropriate action to protect its reputation, including:

•      Formal takedown requestsand DMCA or platform-specific complaints supported by documented evidence

•      Civil litigation fordefamation, trade libel, and intentional interference with business relationsunder California law

•      Claims under CaliforniaBusiness & Professions Code Section 17200 (Unfair Competition Law) forfalse advertising or deceptive business practices

•      Claims for actual damages,reputational harm, lost business, and attorneys' fees where permitted

•      Referral to law enforcementfor violations of California Penal Code Section 646.9 (cyberstalking), Section653.2 (electronic harassment), or applicable federal statutes

 

The Wolfery preserves all formsubmission records, IP addresses, device identifiers, communication logs, andplatform metadata as potential evidence. We will pursue legal remedies withoutprior warning when the conduct is clear and documentable.

8. Privacy

Your use of our Services is alsogoverned by our Privacy Policy, which is incorporated into these Terms byreference. By agreeing to these Terms, you also agree to our Privacy Policy.Our Privacy Policy describes how we collect, use, and protect your personalinformation, and sets forth your rights as a California resident under theCCPA/CPRA.

9. Third-Party Services

Our Services integrate withthird-party platforms including Shopify, Recharge, Stripe, and Webflow. Youruse of these third-party services is subject to their respective terms ofservice and privacy policies. The Wolfery is not responsible for the practicesof these third parties. We recommend reviewing their policies before providingany sensitive information.

10. Termination and Suspension

We reserve the right, in our solediscretion, to suspend or terminate your account and access to our Services,with or without notice, for any of the following reasons:

•      Violation of any provisionof these Terms

•      Submission of false,defamatory, harassing, or abusive content

•      Fraudulent, deceptive, orharmful conduct directed at The Wolfery, its personnel, or other customers

•      Non-payment or repeatedpayment failures

•      Any conduct that, in ourjudgment, poses a legal, reputational, or operational risk to The Wolfery

 

Termination of your account doesnot relieve you of any obligations incurred prior to termination, includingpayment obligations for orders already in production. Sections 5, 6.4, 7, 10,11, and 12 of these Terms survive termination indefinitely.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed byand construed in accordance with the laws of the State of California, withoutregard to its conflict of law provisions. Any disputes arising from or relatingto these Terms or our Services shall be subject to the exclusive jurisdictionof the state and federal courts located in San Francisco County, California.

 

11.2 Informal Resolution

Before initiating any formal legalproceeding, you agree to first contact us at thealpha@thewolferycompany.com andattempt to resolve any dispute informally for a period of at least 30 days.This requirement does not apply to claims for injunctive relief or protectionof intellectual property or reputational rights, for which we may seekimmediate relief without prior notice.

 

11.3 Waiver of Class Action

To the maximum extent permitted byapplicable law, you agree that any dispute resolution proceedings will beconducted on an individual basis only, and not as part of a class,consolidated, or representative action.

12. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitutethe entire agreement between you and The Wolfery Company regarding your use ofour Services and supersede all prior agreements or understandings.

Severability: If any provision of these Terms is found to be invalid orunenforceable, the remaining provisions will continue in full force and effect.

No Waiver: Our failure to enforce any right or provision of theseTerms shall not constitute a waiver of that right or provision.

Assignment: You may not assign your rights or obligations under theseTerms without our prior written consent. We may assign these Terms freely.

Force Majeure: The Wolfery shall not be liable for any failure or delayin performance caused by circumstances beyond our reasonable control, includingnatural disasters, pandemics, supply chain disruptions, or carrier failures.
